1. About Us

This website and online store are operated by BRIHGT UP LLC under the SereniaLife brand. Throughout these Terms, “we,” “us,” and “our” refer to BRIHGT UP LLC.

These Terms govern your use of our website and purchases from our store. Please review them before placing an order.

2. Agreement and Related Policies

When you place an order after being presented with these Terms and accepting them at checkout, you agree to the terms applicable to that purchase.

Our Shipping Policy, Return & Refund Policy, and written product warranty form part of the purchase terms when made available before checkout. Our Privacy Policy explains how we handle personal information.

Specific offer conditions disclosed before purchase apply to that offer. Nothing in these Terms overrides mandatory consumer rights or reduces an express product promise made at the time of sale.

3. Eligibility and Accurate Information

You must be legally able to enter into a binding purchase agreement or have authorization from a parent or legal guardian where permitted by law.

You agree to provide accurate billing, shipping, and contact information and to use a payment method you are authorized to use.

If you create an account, you are responsible for safeguarding your login credentials and notifying us of suspected unauthorized access.

4. Product Descriptions and Availability

We aim to describe products, included components, prices, and availability accurately.

Product colors may appear different depending on your screen. Minor packaging or appearance changes may occur, but we will not substitute a materially different product or reduce the advertised contents of an accepted order without your agreement.

The components included in your purchase are those listed for the selected option at checkout. Props or additional products shown for illustration are not included unless expressly stated.

We may change our product selection or discontinue products prospectively. This does not remove our obligations for orders already accepted.

5. Safety and Intended Use

Our website, advertisements, digital guides, and customer support do not replace professional medical advice, first aid training, or emergency medical assistance.

Before using a product:

• Read all supplied instructions, warnings, and contraindications.

• Check the product’s suitability for the intended user, including any age, size, or other restrictions.

• Follow the manufacturer’s directions concerning assembly, storage, inspection, maintenance, and disposal.

• Observe all single-use limitations. Warranty coverage does not authorize reuse.

• Do not use a damaged product or modify it contrary to its instructions.

The inclusion of different mask sizes does not establish suitability for every adult, child, or infant.

In an emergency, contact local emergency services immediately. In the United States, call 911. Do not delay emergency assistance or recommended first aid while obtaining or using a product. Follow emergency dispatcher instructions.

We do not guarantee that a product will prevent injury, resolve every emergency, or produce a particular medical outcome. This statement does not exclude responsibility for defects, inaccurate product claims, or other obligations imposed by law.

6. Orders and Acceptance

Submitting an order constitutes a request to purchase the selected products.

An automated order acknowledgment confirms receipt of your request; it does not by itself confirm acceptance. We accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance.

Before acceptance, we may decline an order for legitimate reasons, including unavailable stock, payment failure, a material pricing error, delivery restrictions, or reasonably suspected unauthorized activity.

If we decline or cancel an order for which payment has been collected, we will promptly refund the canceled portion. Once an order is accepted, any cancellation by us will remain subject to applicable law.

7. Prices, Taxes, and Payment

The checkout page identifies the currency and total amount payable, including applicable shipping charges and taxes collected by us.

Payment must be authorized before an order is processed. Payments are handled through the payment providers available at checkout and may also be subject to their terms.

If a material pricing or description error affects your order, we will explain the issue and offer the available options. We will not charge a higher price without your consent.

Future price changes do not change the price of an accepted order.

8. Promotions, Bundles, and Free Gifts

Promotions apply only under the conditions disclosed with the offer before purchase. Discounts cannot be combined unless expressly allowed.

For a “Buy 2, Get 1 Free” offer, the qualifying purchase includes three kits for the advertised bundle price. The checkout summary must reflect the applicable offer.

For a full change-of-mind refund on this bundle, all three kits must be returned in eligible condition.

For an approved partial return, the amount actually paid for the bundle is allocated equally across the three kits. The refund reflects the allocated value of the eligible kits returned.

A free promotional item has no separate cash-redemption value. We will not deduct an undisclosed retail value for a free item from your refund.

These conditions do not restrict remedies for defective, damaged, incorrect, or misdescribed products.

9. Digital Guides and Promotional Credit

Any downloadable guide supplied with a purchase is licensed for personal, noncommercial use. You may keep a personal copy but may not resell or commercially distribute it without permission.

Digital guides provide general educational information and are not a substitute for certified training, product instructions, or emergency services.

Any promotional credit or gift card is subject to the conditions disclosed when offered, including eligible purchases and any lawful restrictions. Purchased gift cards and free promotional credits may have different terms.

We will not introduce undisclosed expiry dates, fees, or minimum-spend requirements after issuance. Mandatory gift-card rights remain unaffected.

10. Processing, Shipping, and Delivery

Orders are processed within 3 business days after payment confirmation.

Estimated shipping time is 7–12 business days after dispatch. Processing time is additional, so the total estimated period may be up to 15 business days.

Business days are Monday through Friday, excluding applicable public holidays.

These are estimates, not guaranteed arrival dates. If we cannot ship within the promised period, we will provide the notice, revised timing, cancellation option, and refund required by applicable law.

Carrier delays or events outside our reasonable control do not automatically remove your cancellation or refund rights.

Available destinations and applicable charges are shown at checkout. We do not represent that products ship from the United States unless this is expressly stated for the relevant order.

11. Address Errors and Delivery Problems

Please check your address before completing checkout and notify us promptly of errors.

We will attempt to accommodate address changes, but changes may not be possible after dispatch.

If a package is returned because an address supplied by you was incomplete or incorrect, we will contact you to discuss reshipment or refund options. Any additional charge must be explained and agreed to before reshipment.

For missing packages or deliveries you cannot locate, contact info@sereniavida.com. We will investigate with the carrier. A tracking status showing “delivered” is relevant evidence but does not automatically resolve every claim.

We remain responsible for providing any remedy required by applicable law for confirmed non-delivery.

12. Cancellation Requests

Contact us promptly if you wish to cancel.

If shipment can still be stopped, we will confirm cancellation and refund the canceled order. If the order has shipped, the applicable return process will ordinarily apply.

This does not limit statutory cancellation rights or rights arising from delayed shipment.

13. Returns and Refunds

Our Return & Refund Policy explains the complete procedure.

Change-of-mind return requests may be submitted within 30 calendar days of delivery. Items must be unused, complete, in their original packaging, and with any hygiene seals intact.

Used products and products with broken hygiene seals are not eligible for change-of-mind returns except where required by law. This restriction does not apply to valid claims involving defects, damage, incorrect items, or misdescription.

Contact us before returning an item so we can provide the correct address and handling instructions. Do not return used or potentially contaminated equipment without first obtaining appropriate instructions.

Customers pay change-of-mind return shipping. Where we confirm that an item arrived defective, damaged, or incorrect, we will arrange an appropriate remedy at no additional cost, including return shipping when needed.

We will review returned items within 5 business days of receipt and issue approved refunds within 10 business days of approval, or sooner where legally required. Banks and payment providers may take additional time to display the credit.

Refunds are ordinarily made to the original payment method.

14. One-Year Limited Warranty

Eligible SereniaLife kits include a one-year limited warranty from delivery against manufacturing defects in materials and workmanship, as described in the written warranty available before purchase.

To request service, email info@sereniavida.com with proof of purchase and a description of the issue. We may request reasonably necessary photographs or inspection information.

The warranty does not cover damage caused by misuse, accidental damage, improper storage, or modifications that caused the defect, or ordinary wear. An unrelated modification or service does not automatically void all coverage.

For covered defects, we will arrange repair or replacement at no cost, or a refund if an appropriate repair or replacement is unavailable, subject to applicable law.

The warranty does not guarantee a successful medical outcome, extend any single-use limitation, or replace the need to follow product instructions.

We do not disclaim implied warranties where prohibited by law. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

15. Payment Disputes and Chargebacks

If you have a billing or order concern, please contact info@sereniavida.com so we can investigate and seek a prompt resolution.

Contacting us is not a waiver of your right to dispute a transaction, contact your payment provider, report suspected fraud, or exercise statutory rights. It does not pause any bank or legal deadline.

If a dispute is already open, please tell us so we can coordinate with the payment provider and avoid duplicate reimbursement. A refund may need to be handled through the provider’s dispute process.

When responding to a dispute, we may submit relevant transaction records, the terms presented at purchase, fulfillment and tracking records, customer communications, and refund confirmations, consistent with applicable law and our Privacy Policy.

We may contest claims we reasonably believe are inaccurate using available evidence. We do not impose a penalty merely because a customer raises a good-faith complaint or payment dispute.

Any accidental duplicate reimbursement will be addressed through the payment provider or another lawful process. This does not authorize an undisclosed charge to your payment method.

16. Acceptable Website Use

You may not:

• Use the website or checkout to commit fraud or conduct unlawful activity.

• Use another person’s payment details without authorization.

• Upload malicious software or interfere with website security.

• Attempt unauthorized access to accounts or systems.

• Copy or commercially exploit protected content without permission.

• Submit fabricated documents or knowingly false information in connection with an order or claim.

We may restrict website access for reasonably suspected unlawful activity or material misuse. This does not cancel outstanding refund, warranty, or other legal obligations.

17. Intellectual Property

Original website text, designs, graphics, and other protected materials belong to BRIHGT UP LLC or their respective licensors.

You may view and use the website for personal shopping purposes. Commercial copying, redistribution, or exploitation requires permission unless otherwise permitted by law.

Third-party trademarks remain the property of their respective owners. Their appearance does not by itself establish affiliation or endorsement.

18. Reviews and Submitted Content

Reviews and submissions should reflect genuine experiences and must not unlawfully disclose another person’s private information or infringe their rights.

If you submit a review for publication, you grant us a nonexclusive, royalty-free license to display and reproduce that review in connection with our store and products, subject to applicable law and any consent requirements.

We may format or shorten content without changing its meaning. We will obtain any additional permission required for identifiable images or other protected personal content.

We do not prohibit honest negative reviews or impose penalties for them. Content may be moderated for legitimate reasons such as spam, fraud, unlawful content, or disclosure of private information.

19. Third-Party Services and Links

Our store may use third-party services for hosting, payments, shipping, or other functions. External websites may have separate terms and privacy practices.

We do not control independent third-party websites or endorse every statement they publish. However, using service providers does not remove our obligations as the seller.

20. Privacy and Communications

Personal information is handled as described in our Privacy Policy.

We may send communications reasonably necessary to fulfill and support your order, including confirmations, shipping updates, safety notices, and refund information.

Marketing communications are subject to applicable consent and unsubscribe requirements. Purchasing a product does not automatically authorize every form of marketing contact.

21. Website Availability

We take reasonable steps to maintain the website but cannot promise uninterrupted access, compatibility with every device, or freedom from every technical error.

To the extent permitted by law, we do not warrant continuous availability of website features. This provision concerns website functionality and does not disclaim product warranties or excuse fulfillment of paid orders.

22. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect or consequential commercial losses arising from website use, such as lost business profits or lost business opportunities.

We are not responsible for loss to the extent it is caused by a user’s misuse, unlawful conduct, or failure to follow product instructions, except where applicable law imposes responsibility on us.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury where liability cannot lawfully be excluded or limited.

• Defective or unsafe products where liability is imposed by law.

• Fraud, fraudulent misrepresentation, gross negligence, or willful misconduct.

• Breach of warranties or consumer rights that cannot lawfully be restricted.

• Refunds or other remedies legally owed to you.

Where a limitation is not permitted in your jurisdiction, it does not apply.

23. Events Outside Our Reasonable Control

Events such as severe weather, natural disasters, transportation disruption, or government restrictions may affect performance.

We will communicate material impacts and take reasonable steps to reduce disruption. Such events do not permit indefinite retention of payment for undelivered products or remove cancellation and refund rights required by law.

24. Resolving Complaints

Please send complaints to info@sereniavida.com, including your order number and the outcome you are requesting.

We will review the available information and seek a practical resolution. Informal discussions are voluntary and do not prevent you from contacting a regulator, payment provider, or court, or from taking action to meet a legal deadline.

These Terms do not impose mandatory arbitration or waive class-action rights.

25. Applicable Law and Courts

These Terms are subject to applicable United States federal law and the state law determined by applicable conflict-of-law rules.

Nothing in these Terms deprives consumers of mandatory protections available under the law applicable to their transaction or requires proceedings in a location prohibited by law.

Disputes may be brought before a court with lawful jurisdiction. Any additional jurisdiction-specific provisions must be properly disclosed and validly agreed to.

26. Changes to These Terms

We may update these Terms for future website use and purchases. The revised version will display an updated date.

Changes will not retroactively reduce rights relating to an existing order. The terms presented and accepted when an order was placed continue to govern that order unless a lawful change is expressly agreed.

Where legally required, we will provide additional notice or obtain consent.

27. Severability and Non-Waiver

If a provision is found unenforceable, it will be severed or limited only as permitted by law, and the remaining provisions will continue to apply.

Failure to enforce a provision on one occasion does not waive the right to enforce it later.

28. Entire Purchase Agreement

These Terms, the applicable policies, and the specific product and offer information presented at purchase form the agreement for your order.

Nothing in this section excludes binding pre-contractual representations or rights and remedies relating to misleading statements.
